In the spring of 2022, a jury in New York’s Supreme Court deliberated a question that would have seemed absurd to a judge a century ago: Did an elephant named Happy have the right to habeas corpus? Happy, a 51-year-old Asian elephant at the Bronx Zoo, had spent decades living mostly alone. The Nonhuman Rights Project (NhRP) argued that she was an autonomous, cognitively complex being unlawfully detained. The court ultimately ruled against Happy, stating that the writ of habeas corpus applies only to humans. But the dissenting opinion was explosive.
